These Terms of Service ("Terms") govern your use of the Fastronome mobile application and related services provided by Fastronom CO. By installing and using the Application, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APPLICATION. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE APPLICATION.

1. Definitions

"Company", "we", "us", or "our" means Fastronom CO, a legal entity incorporated under the laws of USA, owner and operator of the Fastronome Application and the Fastronome micro-market network.

"Application" or "App" means the Fastronome mobile application available for download on Google Play and the App Store, enabling Users to access and purchase Products from Fastronome micro-markets.

"User" or "you" means any individual who installs the Application, creates an Account, and accepts these Terms.

"Fastronome Micro-Market" or "Device" means an autonomous self-service retail unit (kiosk, display case, or refrigerator) equipped with the Fastronome hardware and software system, access to which is granted to the User via the Application by scanning a QR code displayed on the Device.

"QR Code" means the unique machine-readable code displayed on the Device, which, when scanned through the Application, opens access to the Micro-Market and initiates a Purchase Session.

"Product(s)" means food, beverages, and other goods physically stocked inside a Fastronome Micro-Market and available for purchase.

"Payment Card" means a valid payment card (Visa, Mastercard, Amex, ArCa, or other supported payment systems) linked by the User to their Account for the purpose of paying for Products.

"3-D Secure (3DS)" means the additional cardholder authentication procedure applied when linking a Payment Card to the User's Account, in accordance with the 3-D Secure standard.

"Account" means the User's personal account in the Application, created upon registration with a mobile phone number.

"Purchase Session" means the period from the moment the User scans the QR Code on the Device until the Device door/compartment is closed and the purchase is automatically processed.

"Pre-Authorization" or "Hold" means a temporary reservation of funds on the User's Payment Card in a pre-configured amount, applied at the start of a Purchase Session.

"Receipt" means the electronic transaction record generated by the Application upon completion of a Purchase Session, listing the Products purchased and the total amount charged.

2. Acceptance of Terms

2.1. These Terms constitute a public offer by Fastronom CO in accordance with Article 453 of the Civil Code of the Republic of Armenia, and govern the relationship between the Company and the User arising from the use of the Fastronome Application.

2.2. You accept these Terms by completing all of the following actions:

  • installing the Application on your mobile device;
  • completing registration with your mobile phone number;
  • tapping the "I Agree" or equivalent confirmation button in the App.

2.3. These Terms become binding on both parties from the moment of acceptance.

2.4. If you do not agree to these Terms, you must not use the Application and must uninstall it from your device.

2.5. Consumer protection matters are governed by the legislation of the Republic of Armenia, including the Civil Code of the Republic of Armenia and the Law of the Republic of Armenia "On Consumer Protection".

3. Eligibility

3.1. You must be at least 14 years of age to create an Account and use the Application. By accepting these Terms, you confirm that you meet this requirement.

3.2. You must be a resident of or physically present in a location where the Fastronome service is available.

3.3. You must have a valid mobile phone number and a valid Payment Card in your name to use the full functionality of the Application.

4. Account Registration

4.1. To use the Application, you must register by providing a valid mobile phone number that you legally own.

4.2. Phone number verification is completed by one of the following methods:

  • a one-time password (OTP) sent via SMS to your mobile number; or
  • an automated incoming phone call for verification.

4.3. You must only register a phone number of which you are the lawful owner. The Company accepts no liability for any consequences arising from the use of a third party's phone number.

4.4. You are solely responsible for maintaining the confidentiality of your Account credentials, including your phone number, PIN, password, and biometric data. You must notify the Company immediately if you become aware of any unauthorized access to your Account.

4.5. One Account may only be registered per mobile phone number. Creating multiple Accounts is not permitted without the Company's prior written consent.

4.6. The Company reserves the right to suspend or terminate your Account if you violate these Terms.

5. Payment Card Linking and Payment Terms

5.1. To make purchases through the Application, you must link at least one valid Payment Card to your Account.

5.2. Payment Card linking is carried out within the Application and requires mandatory 3-D Secure (3DS) verification. During verification, the Company may apply a minimal test Pre-Authorization, which will be immediately released.

5.3. The Company does not store full Payment Card details. Card data storage and processing are handled by a certified payment processor in compliance with the PCI DSS standard.

5.4. By linking a Payment Card, you confirm that:

  • you are the lawful cardholder; and
  • you are authorized to carry out payment transactions with that card.

5.5. If a payment fails (bank decline, insufficient funds, or technical error), the Company will notify you via the Application. You must settle the outstanding amount within 24 hours. The Company may restrict your access to Fastronome Micro-Markets until the balance is cleared.

5.6. All Product prices are displayed in Armenian Drams (AMD) unless otherwise stated in the Application.

6. How to Use a Fastronome Micro-Market

6.1. To make a purchase, follow these steps:

  1. Open the Fastronome Application on your mobile device.
  2. Tap the scan button and point your camera at the QR Code displayed on the Fastronome Device.
  3. Once access is granted, open the Device and take Product.
  4. Scan Products QR or BAR code to add Product to Receipt.
  5. Close the Device door or compartment when done.
  6. Wait for your Receipt to appear in the Application.
  7. Review your Receipt. Payment is processed automatically.

6.2. You are responsible for all Products taken during a Purchase Session opened under your Account, regardless of who physically accessed the Device.

6.3. If the items listed on your Receipt do not match what you actually took, you must contact the Company's support service within 24 hours of receiving the Receipt.

7. User Obligations and Prohibited Conduct

7.1. You agree to:

  • use the Application and Micro-Markets only for their intended purpose;
  • provide accurate and truthful information at registration and during use;
  • pay for all Products taken during your Purchase Sessions;
  • not damage the Device or its contents;
  • not share your Account access with third parties to use a Micro-Market.

7.2. You must not:

  • attempt to bypass, disable, or circumvent the Product tracking, access control, or payment systems;
  • use the Application for any unlawful purpose;
  • reverse engineer, decompile, or modify the Application;
  • create multiple Accounts without authorization;
  • use automated tools or bots to interact with the Application.

7.3. In the event the Company determines that you have deliberately circumvented the Product tracking system or engaged in any fraudulent activity, the Company reserves the right to:

  • immediately suspend or terminate your Account;
  • charge your Payment Card for the value of unrecorded Products;
  • report the incident to law enforcement authorities of the Republic of Armenia.

8. Company Rights and Obligations

8.1. The Company agrees to:

  • maintain the availability and functionality of the Application and Fastronome Micro-Markets;
  • process your personal data lawfully and maintain its confidentiality;
  • provide customer support;
  • issue a Receipt for each completed Purchase Session.

8.2. The Company reserves the right to:

  • amend these Terms with at least 10 days' prior notice via the App;
  • suspend Application or individual Micro-Market availability for maintenance, with advance notice where possible;
  • restrict or terminate your Account access for breach of these Terms;
  • use video surveillance and computer vision systems to record purchases and ensure security of Devices;
  • update Product assortment and pricing without prior notice.

9. Returns and Dispute Resolution for Purchases

9.1. Due to the nature of Products sold through Fastronome Micro-Markets (food, beverages, and consumer goods), returns of Products in satisfactory condition are not accepted.

9.2. If you receive a Product that is defective or unfit for consumption (expired, damaged packaging, etc.), you may contact the Company's support service within 24 hours of the purchase, attaching photographic evidence.

9.3. Upon review of your claim, the Company may:

  • refund the value of the defective Product to your Payment Card; or
  • provide alternative compensation as agreed with you.

9.4. If the items on your Receipt do not match the Products you actually took, contact support within 24 hours. Claims are reviewed taking into account Micro-Market tracking data (video footage, sensor data).

9.5. Approved refunds are processed to your Payment Card within 5 (five) business days.

10. Privacy and Personal Data

10.1. By accepting these Terms, you consent to the Company processing the following personal data:

  • mobile phone number;
  • device information (model, OS, unique identifiers);
  • purchase history;
  • location data (if permission is granted by you);
  • Payment Card details in anonymized form (last 4 digits, card type, issuer country).

10.2. Your personal data is processed for the purposes of:

  • performing our obligations under these Terms;
  • identifying you within the Application;
  • processing payments;
  • improving the Application and Micro-Market services;
  • sending you informational and marketing communications (subject to your consent).

10.3. The Company does not sell or share your personal data with third parties, except:

  • certified payment processors, for payment processing purposes;
  • technical service providers supporting the Application, under confidentiality agreements;
  • government authorities, where required by the laws of the Republic of Armenia.

10.4. Personal data is processed in accordance with the personal data legislation of the Republic of Armenia.

10.5. You may request correction or deletion of your personal data by contacting the Company's support service.

10.6. The Company applies technical and organizational measures to protect your personal data against unauthorized access, including SSL/TLS encryption.

10.7. A full description of our data practices is available in our separate Privacy Policy, which forms part of these Terms.

11. Intellectual Property

11.1. All rights to the Application, including source code, design, trademarks, the Fastronome logo, and all other intellectual property, belong to the Company or are used by the Company under valid licenses.

11.2. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Application solely for personal, non-commercial purposes.

11.3. You may not copy, modify, decompile, distribute, sublicense, or otherwise exploit the Application beyond the rights expressly granted herein.

12. Disclaimer of Warranties

12.1. The Application and Fastronome Micro-Markets are provided "as is" and "as available". The Company makes no warranties, express or implied, regarding:

  • uninterrupted or error-free availability of the Application or Micro-Markets;
  • the availability of any specific Product at any given time.

12.2. The Company is not liable for:

  • temporary unavailability of the Application or individual Micro-Markets due to technical issues, maintenance, or force majeure;
  • payment declines by your card issuer;
  • unauthorized Account access resulting from your failure to secure your credentials.

12.3. The Company's liability for any single incident is limited to the value of the Products that are the subject of the dispute in that incident.

13. Force Majeure

13.1. Neither party shall be liable for failure to perform its obligations under these Terms if such failure results from circumstances beyond its reasonable control arising after the Terms came into effect.

13.2. Force majeure events include, without limitation: natural disasters, accidents, fires, military actions, epidemics, acts of government, internet or telecommunications network outages, and any other extraordinary circumstances beyond the reasonable control of either party.

13.3. The party affected by force majeure must notify the other party as soon as reasonably practicable.

14. Amendments to These Terms

14.1. The Company reserves the right to amend these Terms at any time. You will be notified of any changes via the Application no less than 10 (ten) days before the amendments take effect.

14.2. Your continued use of the Application after the effective date of the amended Terms constitutes your acceptance of the updated Terms.

14.3. If you do not agree to the updated Terms, you may terminate your Account and uninstall the Application.

15. Termination

15.1. You may terminate these Terms at any time by requesting deletion of your Account through the support service, provided you have no outstanding balance owed to the Company.

15.2. The Company may suspend or terminate your Account and access to the Application if you:

  • breach any provision of these Terms;
  • engage in fraudulent or unlawful activity;
  • have been inactive for more than 12 consecutive months.

16. Governing Law and Dispute Resolution

16.1. These Terms are governed by the laws of the Republic of Armenia.

16.2. Any disputes arising out of or in connection with these Terms shall first be submitted to the Company's support service. The Company will respond to claims within 10 (ten) business days.

16.3. If a dispute cannot be resolved through negotiation, it shall be referred to the competent courts of the Republic of Armenia.

17. General Provisions

17.1. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Application.

17.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3. The Company's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4. These Terms are effective from the moment of acceptance and remain in force until terminated in accordance with Section 15.

17.5. These Terms are published in English. In the event of any conflict between language versions, the English version shall prevail.
